Update on Flower Mound Cares and Lewisville ISD (Corrected)

Recently, we've reported on the efforts by the Flower Mound group "Flower Mound Cares" to circulate a petition calling for a 180 day permit moratorium on new gas wells in the city.

One story we posted related to the group's planned use of Lewisville ISD elementary school parking lots in the first weekend of signature gathering, and how the district had seemingly been prepared to tolerate their presence, then sent another email seemingly revoking the permission.

Since the accusation by some readers / commenters was that somehow Flower Mound Mayor Jody Smith had gotten to LISD ans asked them to stop the group, we sent an open records request to Lewisville ISD, and received 69 pages of emails this past Friday.

To get directly to the point, although we do know that Board President Carol Kyer did have a conversation with Smith, there were no emails from anyone associated with the Town of Flower Mound, related to Flower Mound Cares or the petition group.

Rather, the emails seem to suggest that LISD was content to tolerate the petitioners using the property on weekends, but that they were unable, by district policy to grant any sort of permission. As Kyer described it, the district does not have personnel to enforce this rule, which is mostly related to liability.

It appears the district did send a more direct message to Ginger Simonson of F.M. Cares only after hearing from an angry Flower Mound Resident who opposes the group.

Marsha Gavitt, former director of the political action committee "Flower Mound Voters United" emailed Superintendent Dr. Jerry Roy and all 7 board members on Tuesday, February 16th with a list of questions and accusations about the group.

Gavitt refers to the group as a "politically-motivated organization" and claims that the group "planned to recall several town officials because two large HOA's disapproved of a council vote". Gavitt also alleges in the email that "this group and its affilliations have engaged in activities that have jeopardized the welfare of hundreds of other LISD families (including non-HOA's) directly impacted by gas drilling"..

In a followup email, after Dr. Roy explained that the group had no permission to use the campuses, Gavitt asked whether LISD should "notify the Flower Mound Police to prevent the unauthorized use and protect LISD from any potential liability issues".

We attempted to contact Gavitt on Friday, and she has not responded. Flower Mound Cares member Ginger Simonson was puzzled by the allegations, and reiterated that the group was only about stopping the centralized waste collection. She also reiterated that Flower Mound Cares is not a PAC, and said she didn't know Marsha Gavitt or have any idea why she would have objected.

So there you have it: The former director of a political action committee whose website seems to show concern about gas drilling accuses a non-partisan, non-political group of being "politically motivated", then seeks to have the Flower Mound police keep the group from exercising their first amendment rights to assembly, speech, and the redress of grievances.

Correction 3/8/2009: Although Gavitt's name was on the group's website, Gavitt is no longer a director of Voters United, as former Mayor DeLuca says below.

Amazing what a little greed can do. This was Marsha Gavitt's position in 2006 (her words):

From Marsha Gavitt of Voters United to Preserve Flower Mound:
A gas driller has submitted a request for a "blanket drilling permit" on property north of FM 1171, east of Shiloh Road , and west of Lusk Lane. They are also asking for waivers of the town’s required setbacks from adjacent property owners and environmentally sensitive areas. Blanket permits appear to be a new way to circumvent our protective drilling ordinance and to reduce the ability of residents to be informed and to have their concerns addressed.....

I just read your blog about the emails from Marsha Gavitt regarding the Flower Mound Cares Petition Drive.

I don't understand how the name of Voters United got dragged into this. Marsha Gavitt did not identify herself as representing Voters United or being the Director of Voters United in any of her correspondence with LISD.

Voters United to Preserve Flower Mound is not currently active in town politics and Marsha Gavitt no longer represents Voters United in any way.

Marsha Gavitt's name was removed from our website last year before Flower Mound Cares was organized. This was per her own request. I suspect she requested this because she knew her opinions and goals had changed and were no longer the same as the goals of Voters United, which are clearly stated on our website at www.voters-united.com

I am the founder of Voters United. I am the registered owner and treasurer. I am currently the only person authorized to speak on behalf of the organization.

I am personally opposed to the Centralized Collection Facility. I support the Flower Mound Cares Petition Drive. I have signed the petition and encouraged others to do so. I am, and always have been, a very strong believer in the right of legislation by the people through initiative and referendum.

Please feel free to share this with anyone who questions my personal position or claims Voters United to Preserve Flower Mound was involved in this in any way.

When Mayor Deluca was in office, we never had to worry about outside interests at Town Hall. It was a comfortable convenience, maybe too comfortable. Since 2004, we've had to fight to keep the very essence of what Flower Mound is. The Gavitt's have sold out to outside interest, something they used to fight, what a shame.

Former Mayor DeLuca's comments are a breath of fresh air in this stinky gas debate. I'm not sure why people have to drag Voter's United into everything, but it just makes me think about the good old days when DeLuca was Mayor and we could all go to sleep at night not worrying if Flower Mound was going to be a different place when we woke up the next morning.

Good to here from our former Mayor. I didn't always agree with how slowly development came under her tenure but we knew what Flower Mound stood for and we had principles we could count on. I wish Ms. Deluca would/could run again. How many ways could you spell landslide. I wish Ms. DeLuca the best and thank her for adding her important thoughts to the on going debate.

THANKS for getting this information. It's always nice to see who is [trying] to pull strings around town and at LISD. Thanks for your continued efforts to keep everyone honest and accountable. Keep up the great work!
