We've just learned that the Lewisville ISD Board of Trustees is planning to meet for a Board Retreat on Thursday and Friday, though they have failed to properly post the notice of the meeting on the public website at LISD.net. (As of about 3PM today. Will post screenshots later if needed)

As of this afternoon, the required notice on the LISD website had not been posted as required by Texas Government Code, Sec. 551.056, which requires school districts with websites to post both meeting notices and agendas.
Our photographer visited district headquarters in Flower Mound and snapped a photo of the paper notice, which was posted on October 30th, 5:00 PM.
According to Board member Fred Placke, the first session tomorrow from 8:30am to 12:00 noon is a non-public team-building exercise, which is considered closed because it is a personnel matter. This meeting counts toward yearly educational requirements for board members. From 1:00 PM to 4:30 PM Thursday and from 8:30am to 4:30pm on Friday, the Board is scheduled to meet with LISD Executive Administrators.
LISD Spokeswoman Karen Permetti was said to be checking out the situation but had not immediately responded as of posting time. Update: We did just get this update from Permetti:
The Board Retreat is this Thursday and Friday at the Bolin Center. Per the Board secretary, this agenda was posted on Oct. 30 at both of the Administration Building doors, which meets the open meetings law requirement. Historically, LISD hasn't posted Board annual retreat agendas online since no action is taken during these retreats. All parts of the meeting are open. On Thursday morning, the Board will do team building exercises for the first half of the day. This is required by the Texas Association of School Boards. The remainder of the afternoon, presentations will be made regarding the recent communication audit and new staff development initiatives. On Friday, the Board will cover enrollment projections, information about the AVID program and tax ratification options.
Since this is my first year in the Public Information Officer seat for Lewisville ISD, I was unaware that we didn't post Board retreat agendas online. I made this recommendation that in the future we post all retreat agendas online.

We're not lawyers, but the language of the statute seems pretty clear to us, and when we read it to Trustee Fred Placke, he agreed that it seemed like they were not in compliance.
Sec. 551.056. ADDITIONAL POSTING REQUIREMENTS FOR CERTAIN MUNICIPALITIES, COUNTIES, SCHOOL DISTRICTS, JUNIOR COLLEGE DISTRICTS, AND DEVELOPMENT CORPORATIONS. (a) This section applies only to a governmental body or economic development corporation that maintains an Internet website or for which an Internet website is maintained. This section does not apply to a governmental body described by Section 551.001(3)(D). (b) In addition to the other place at which notice is required to be posted by this subchapter, the following governmental bodies and economic development corporations must also concurrently post notice of a meeting on the Internet website of the governmental body or economic development corporation: (1) a municipality; (2) a county; (3) a school district; (4) the governing body of a junior college or junior college district, including a college or district that has changed its name in accordance with Chapter 130, Education Code; (5) a development corporation organized under the Development Corporation Act (Subtitle C1, Title 12, Local Government Code); and (6) a regional mobility authority included within the meaning of an "authority" as defined by Section 370.003, Transportation Code. (c) The following governmental bodies and economic development corporations must also concurrently post the agenda for the meeting on the Internet website of the governmental body or economic development corporation: (1) a municipality with a population of 48,000 or more; (2) a county with a population of 65,000 or more; (3) a school district that contains all or part of the area within the corporate boundaries of a municipality with a population of 48,000 or more; (4) the governing body of a junior college district, including a district that has changed its name in accordance with Chapter 130, Education Code, that contains all or part of the area within the corporate boundaries of a municipality with a population of 48,000 or more; (5) a development corporation organized under the Development Corporation Act (Subtitle C1, Title 12, Local Government Code) that was created by or for: (A) a municipality with a population of 48,000 or more; or (B) a county or district that contains all or part of the area within the corporate boundaries of a municipality with a population of 48,000 or more; and (6) a regional mobility authority included within the meaning of an "authority" as defined by Section 370.003, Transportation Code. (d) The validity of a posted notice of a meeting or an agenda by a governmental body or economic development corporation subject to this section that made a good faith attempt to comply with the requirements of this section is not affected by a failure to comply with a requirement of this section that is due to a technical problem beyond the control of the governmental body or economic development corporation.

We asked Placke if he could send us an electronic copy of the agenda, but he admitted that he doesn't have it in electronic format. Placke did state that the retreat meeting is all about planning and that no votes take place during this time, and that citizens are not allowed to speak - though they would be allowed to attend the public portion of the meetings.
Further, LISD is in violation of section 551.052, which requires special notice of meetings to any news media who have requested it. WhosPlayin had requested this back on September 15th and again on September 16th.
It seems that what we have here is a failure to communicate. |
